Terms of Use (EULA)

1. Agreement & Parties

This End-User License Agreement ("EULA" or "Terms") is a legal agreement between you ("User") and Bamboo Grove AI LLP, a company registered in England & Wales ("Developer," "we," "us," or "our"), governing your use of the Visa Photo mobile application (the "App").

This EULA incorporates and supplements Apple's standard Licensed Application End User License Agreement. In the event of a conflict, Apple's terms control with respect to the App Store relationship.

2. License

We grant you a revocable, non-exclusive, non-transferable, limited license to download, install, and use the App on Apple-branded devices you own or control, solely for your personal, non-commercial purposes, in accordance with these Terms and Apple's Usage Rules.

The App may be shared via Apple Family Sharing or volume purchasing programs where enabled.

3. Age Requirement

You must be at least 17 years old (or the age of majority in your jurisdiction, whichever is higher) to use the App. By using the App, you confirm you meet this requirement. We do not knowingly permit use by individuals under 13 years of age.

4. Subscriptions, Free Trials & Billing

• The App offers optional premium features via weekly, monthly, or yearly subscriptions, processed exclusively through Apple's In-App Purchase system.
• Free Trial: Where offered, a free trial automatically converts to a paid subscription unless you cancel at least 24 hours before the trial ends.
• Auto-Renewal: Subscriptions automatically renew at the end of each billing period unless you turn off auto-renewal in your Apple ID Account Settings at least 24 hours before the renewal date.
• Price Changes: We will notify you of any price changes in advance. Continued use after the effective date constitutes acceptance.
• Refunds: All payments are processed by Apple. We have no ability to issue refunds directly. To request a refund, contact Apple Support.
• No Partial Refunds: Unused portions of a subscription period are not refunded when you cancel mid-cycle.

To manage or cancel your subscription: Settings → [Your Name] → Subscriptions.

5. Important Disclaimers & Limitation of Liability

• No Guarantee of Acceptance: The App is a tool to help you prepare photos that conform to published official standards. We do not guarantee that photos produced by the App will be accepted by any embassy, consulate, government authority, or third-party service. Requirements vary by country and change without notice.
• Your Responsibility: You are solely responsible for verifying that your final photo meets the current, specific requirements of the authority to which you are submitting. Always consult the official guidance of the issuing authority.
• No Liability for Rejection: To the maximum extent permitted by applicable law, we shall not be liable for visa denials, application rejections, travel disruptions, financial losses, or any other direct or indirect damages arising from the use or inability to use the App.
• "As Is" Service: The App is provided "as is" and "as available," without warranties of merchantability, fitness for a particular purpose, or accuracy of results.
• Maximum Liability: In any case where liability cannot be fully excluded, our total liability to you shall not exceed the amount you paid for the App in the 12 months preceding the claim, or USD $10, whichever is greater.

6. Prohibited Uses

You agree not to:

• Use the App to create fraudulent, falsified, or misleading identification documents;
• Submit photos of any person without their express consent;
• Use the App for any unlawful purpose or in violation of any applicable law or regulation;
• Reverse engineer, decompile, or attempt to extract the source code of the App;
• Copy, modify, distribute, sell, or sublicense the App or any part of it;
• Use the App in any way that infringes the intellectual property rights of any third party;
• Attempt to circumvent any security or access control features of the App.

Violation of these restrictions may result in immediate termination of your license and may expose you to civil or criminal liability.

7. User Content & Photos

Photos you take or import using the App remain your property. We do not upload, store, or claim any ownership over your photos. All image processing occurs locally on your device. You are solely responsible for the content of photos you create or submit for processing.

8. Intellectual Property

All rights in the App, including algorithms, visual designs, user interface, brand assets, and trademarks, are the exclusive property of Bamboo Grove AI LLP or its licensors. Nothing in these Terms grants you any rights in the App other than the limited license described herein.

9. Third-Party Services & Links

The App may display links to or integrate with third-party websites and services. We are not responsible for the content, privacy practices, or availability of such third-party services. Your use of third-party services is subject to their respective terms and policies.

10. Export Compliance

The App may be subject to export control laws and regulations. You agree that you will not export or re-export the App to any country, person, or entity in violation of applicable export laws, including U.S. Export Administration Regulations and UK export control legislation.

11. Termination

This EULA is effective until terminated. Your rights under this license will terminate automatically if you fail to comply with any of its terms. You may terminate this agreement at any time by deleting the App from your device. Upon termination, all rights granted to you cease immediately.

12. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by updating the "Last Updated" date and, where appropriate, via in-app notification. Continued use of the App after changes take effect constitutes acceptance of the revised Terms.

13. Dispute Resolution & Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the App shall be resolved by the courts of England and Wales, except where mandatory local law provides otherwise.

For users in the EU/EEA: nothing in these Terms limits your rights under applicable European consumer protection laws or your right to bring a claim before the competent court in your country of residence.

14. General Provisions

• Severability: If any provision is found unenforceable, that provision will be modified to the minimum extent necessary, and the remaining provisions will continue in full force.
• Waiver: Failure to enforce any right or provision shall not constitute a waiver of that right.
• Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the App.
• Force Majeure: We are not liable for any failure to perform due to circumstances beyond our reasonable control.
• Assignment: You may not assign your rights or obligations under these Terms without our prior written consent.
